Texas Insurance Law The TX Deductible Law and How Legacy Can Help
Texas law requires you to pay your insurance deductible, but that doesn't mean you need to pay it all at once. Legacy offers 12-month same as cash deductible assistance and flexible options to help you protect your home today.
Understanding the Law What Is Texas House Bill 2102?
Texas House Bill 2102 went into effect on September 1, 2019, updating the state's insurance deductible laws to protect homeowners from deceptive practices. The law makes it a Class B misdemeanor for any contractor to waive, absorb, or help a homeowner avoid paying their insurance deductible.
Before HB 2102, some disreputable contractors lured homeowners with promises of "free roofs" by secretly absorbing deductibles, then cutting corners on the work to make up the difference. This law levels the playing field for honest contractors and protects homeowners from shoddy work.
Required Contract Notice
Every contract of $1,000 or more that's expected to be paid from insurance proceeds must include the HB 2102 notice in at least 12-point boldface type.
Deductible Must Be Paid
Homeowners are legally required to pay their insurance deductible. No contractor can waive, absorb, credit, or offset it in any way.
Violations Are Criminal
Contractors who waive or pay deductibles face a Class B misdemeanor, up to 180 days in jail and a $2,000 fine. Homeowners who accept can also be charged.
Proof of Payment Required
Insurers can refuse to release replacement cost holdback until they receive proof of deductible payment, canceled check, credit card statement, or installment plan contract.
Required by Law Required Contract Language
Under HB 2102, all contracts of $1,000+ expected to be paid from insurance proceeds must include the following notice in at least 12-point boldface type:
"Texas law requires a person insured under a property insurance policy to pay any deductible applicable to a claim made under the policy. It is a violation of Texas law for a person or business paid wholly or partly from proceeds of a property insurance claim to knowingly allow the policyholder to fail to pay, or assist the policyholder's failure to pay, the applicable insurance deductible."
Legacy is fully compliant. Every Legacy contract includes this exact language in 12-point boldface, along with a dedicated section to document your deductible amount and payment method. We've followed HB 2102 since day one.

Red Flags: When to Walk Away
If a contractor offers any of the following, they're breaking Texas law, and putting you at legal risk too:
✕"We'll cover your deductible" ✕"Free roof, no out-of-pocket cost" ✕"We'll give you a rebate for the deductible" ✕"Sign today and we'll waive the deductible" ✕"Don't worry about the deductible" ✕"We'll find a way to work around it" Remember: Contractors who waive deductibles often inflate claims, use cheap materials, or skip critical steps. You end up with a roof that fails early, and possibly criminal charges. Always choose a reputable, HB 2102-compliant contractor like Legacy.
