Back to Blog Regulations Do You Need a Permit to Replace Your Roof in San Antonio? (Yes. Here's Why.)
Mark WhiteAugust 20, 20255 min read "Do I really need a permit to replace my roof?" I get this question at least twice a week. The answer is yes. Every time. Without exception in San Antonio.
I know permits aren't exciting. Nobody wakes up thrilled about paperwork. But here's the thing, the permit process exists to protect you, and skipping it can cost you way more than the small filing fee (starting around $25 in San Antonio).
When Exactly Is a Permit Required?
San Antonio's Development Services Department (DSD) requires a building permit for any roof replacement or major roof repair. Full tear-off and replacement? Permit. Adding a new layer over existing shingles? Permit. Repairing a large section? Probably a permit.
Minor repairs, a handful of shingles, some sealant around a vent pipe, generally don't trigger the permit requirement. But when in doubt, file one. The cost is trivial compared to the risk.
Who Pulls the Permit?
Your contractor. Period. At Legacy, we handle all permitting as part of our standard process. It's built into how we operate because it's the right way to do business.
Red flag alert: if a roofer says "permits aren't needed" for a full replacement, or asks YOU to pull the permit, run. They're either cutting corners or unlicensed. Neither is good for your home.

No permit means no official record of your roof replacement. And that means:
- Your homeowner's insurance may deny future claims ("unpermitted work" is a common denial reason)
- City fines if discovered during a sale or other inspection
- Title complications when selling, title companies check permit history, and unpermitted roof work is a red flag for buyers
- No documentation that the work met current building code
- Potential liability if the work causes damage to a neighbor's property
The Process (It's Not That Bad)
Your contractor submits the application to DSD, pays the fee, and gets approval before work starts. The permit documents that the work is being done by a contractor licensed in San Antonio to current building code. The permit is usually ready the same day or next business day. That's it.
At Legacy, we've been pulling San Antonio permits since 1999. We know the DSD team, we know the requirements, and we handle 100% of the paperwork. You don't have to think about it.
