Back to Blog Insurance Does Homeowners Insurance Cover Roof Replacement in Texas?
Mark WhiteJanuary 22, 20266 min read "Will my insurance pay for a roof replacement?" is the second-most common question I get (right after "how much does a roof cost?"). The honest answer is: sometimes yes, sometimes no, and the difference usually comes down to what caused the damage and what kind of policy you have.
I'm not an insurance agent, but I've worked alongside every major insurer in Texas for 25+ years. Here's what I've learned.
When Insurance DOES Cover Roof Replacement
Insurance covers roof damage caused by sudden, accidental events, what they call 'covered perils':
- Hail damage (the most common in San Antonio by far)
- Wind damage from storms, tornadoes, or hurricanes
- Fire damage
- Fallen trees or large debris
- Lightning strikes
When Insurance Does NOT Cover Roof Replacement
Insurance generally won't cover:
- Normal wear and tear, your roof aging out is not a covered event
- Neglected maintenance, if you never cleaned your gutters and water backed up under your shingles, that's on you
- Cosmetic damage (on some policies), some newer Texas policies have 'cosmetic damage exclusions' that won't cover hail dents that don't affect function
- Pre-existing damage, if your roof was already compromised before the storm, insurers will deny the claim
- Manufacturer defects, this falls under the manufacturer's warranty, not your homeowner's policy

Try the Instant Estimator →ACV vs. RCV: The Policy Detail That Changes Everything
This is the single most important thing in your policy for roofing: Actual Cash Value (ACV) vs. Replacement Cost Value (RCV).
RCV policies pay to replace your roof with equivalent new materials. ACV policies depreciate your roof based on age, so if your 15-year-old roof needs replacement, they'll subtract 15 years of depreciation. On a $15,000 roof, that could mean the insurance only pays $5,000-$7,000.
Many Texas homeowners don't realize they have ACV policies until they roofing storm damage restoration. Check your declarations page right now. If you have ACV, consider switching to RCV at your next renewal, the premium difference is usually modest.
Your Deductible: What HB 2102 Means for You
Under Texas Insurance Code 707.002 (HB 2102), it is a criminal offense for any contractor to pay, waive, or absorb your insurance deductible. If a roofer offers to "eat the deductible" or "work with you on the deductible", that's not a deal, that's a crime. And it usually means they're inflating the claim or cutting corners on materials.
Your deductible is your responsibility. At Legacy, we've never once offered to waive a deductible in 25+ years. We provide thorough documentation so your claim accurately reflects the damage.
